GENERAL OVERVIEW

Contingent upon full compliance with these Terms & Conditions, SUREBET Prize Company(SB) hereby agrees to reimburse each registered contestant in the event named in the Certificate of Coverage up to the specified prize value for each and every hole in one (as defined by the United States Golf Association [USGA] Rules of Golf) that occur during the eligible contest and in accordance with the contest details specified on the Certificate of Coverage. The rights and obligations of the parties to the Certificate of Coverage are exclusive to the contracting parties, may not be assigned, transferred, or delegated, and are not intended to create any third-party beneficiary rights for any contestant in the eligible contest.

SUREBET APPLICATION REQUIREMENTS

Prior to the eligible contest, a completed and signed SUREBET Certificate of Coverage along with valid and full payment must be:

  • Payment: Submitted and paid prior to the event date and start time for the applicable contest via the provided payment link, at www.weinsurefun.com or via check mailed to 11289 East Lakewood Blvd, Holland MI 49424.
  • Certificate of Coverage / Terms & Conditions: Submitted and signed prior to the event date and start time for the applicable contest via the eSign Link provided and emailed to you or hand signed and emailed to sales@weinsurefun.com or hand signed and faxed to (877) 556-6354.

Absent timely submission of full payment and a completed and signed SUREBET Certificate of Coverage by applicant results in SUREBET having no obligation to reimburse its Participating Applicant or associated parties. The confirmed / signed Certificate of Coverage will supersede all prior agreements or representations, whether written or oral, and contains the full agreement of both parties. The submitted SUREBET Certificate of Coverage and payment will control in the event of any inconsistencies.

TOURNAMENT HOLE-IN-ONE (THIO) CONTEST REQUIREMENTS

In order for the Participating Contestant to be eligible, the eligible contest must be either held in a tournament or shoot-out format, as defined in the SUREBET Application. Participating Applicant must guarantee the presence of witnesses, age 21 or older and not participating in the contest as follows: For prize values up to $10,000, two playing partners will be acceptable as witnesses. For prizes greater than
$10,001 up to $60,000, one witness is required; $60,001 to $150,000, two witnesses are required; $150,001 -$250,000 two witnesses (one of which is a PGA certified Golf Professional) are required; greater than $250,001, two witnesses (one of which is a PGA certified Golf Professional or a Police Officer) are required as well as a continuous, unedited videotape shot from behind the green of all shots to win the prize. All witnesses must be located green-side, in full view of the green and tee at all times, and out of harm’s way. All liability for the safety of the witnesses is borne by the Participating Applicant. SUREBET is not obligated to reimburse its Participating Applicant or Contestant for a prize if a hole in one occurs without the verifiable presence of witnesses (and videotape if applicable) as specified above. All shootout contests require a continuous, unedited videotape shot from behind the green of all shots regardless of the prize value. From the point on the teeing area from which each shot is initiated to the flag stick, the eligible hole(s) must measure no less than the specified yardage on the Certificate of Coverage. Women (amateurs only) may shoot from a yardage of up to 15 yards less than the specified yardage (shoot-out formats excluded) but never less than 100 yards. Do not trust the tee markers to be set at the correct yardage. Prior to the start of the eligible contest, with assistance from the Golf Professional, set the tee markers using a range finder or the in-ground yardage markers (keeping in mind that the hole location will affect the overall yardage). SUREBET is not obligated to reimburse its Participating Applicants or Contestants for a prize, or any portion thereof, if the actual yardage of a hole in one is less than the yardage specified on the Certificate of Coverage. A “Shot” is defined as a “stroke” by the USGA Rules of Golf. In order for a shot to be eligible, it must be taken by an officially pre-registered or pre-qualified contestant whose amateur or professional status is correctly specified on the Certificate of Coverage. Only one shot per contestant per eligible hole is permitted. Practice or qualifying shots, mulligans, or substitute shots for other contestants from the specified yardage are not permitted. A contestant is an “Amateur” if they meet the USGA Rules of Amateur Status on the date of the eligible contest. A contestant that does not qualify as an “Amateur” is a “Professional.” GSG is not obligated to reimburse its Participating Applicant or Contestant for a prize if the winner’s amateur or professional status is not correctly specified on the Certificate of Coverage. A regulation (as defined by the USGA Rules of Golf) four and one-quarter (4 1/4) inch hole must be used. Only one hole (cup) may be cut in each eligible hole green without written permission from SUREBET. On nine (9) hole courses, it is conclusively presumed that the first time a hole is played it is numbered one (1) through nine (9), and the second time it is played it is numbered ten (10) through eighteen (18) and it is assumed that only the first time playing the contest hole is a contestant eligible to win a prize. SUREBET is not obligated to reimburse its Participating Applicant for a prize if a hole in one occurs on any hole not specified on the Certificate of Coverage. SUREBET will provide up to three auxiliary hole in one prizes (valued at $500 each) to be offered on non-eligible contest holes (tournament format contests only) unless noted differently on certificate of coverage. There are no yardage requirements for three auxiliary hole in one prizes. No witness is required, yet a minimum of two playing partners must verify the occurrence of a hole in one. SUREBET reserves the right to substitute auxiliary prizes of equal or greater value.

IN THE EVENT OF A WINNER

Participating Applicant must report the occurrence of a winner to the claims department via telephone or email no later than 24 hours from the event. The following documentation must be provided to SUREBET in connection with an eligible contest no later than ten (10) business days following the contest:

  •  Affidavits by the Winner and any required witnesses pursuant to the conditions above (forms will be furnished by SUREBET).
  • A continuous, unedited videotape pursuant to the conditions above (SUREBET can provide equipment for a fee).

Upon receipt of the documentation specified above, SUREBET shall conduct a reasonable investigation of the facts surrounding Winner and applicable contest. SUREBET reserves the right to

require the Participating Applicant to produce the Winner and Witnesses for a polygraph examination as a condition to prize reimbursement if, in the sole opinion of SUREBET, such an examination is warranted by the facts. All polygraph examinations will be completed by a licensed American Polygraph Association Applicant selected by SUREBET. SUREBET is not obligated to reimburse its Participating Applicant for a prize, if, in the sole opinion of the polygraph examiner or any details of the investigation suggest deception or inconsistency if the Winner or any Witnesses fails to pass (i.e., no attempted deception).

DISPUTE RESOLUTION

Any and all disputes between the Participating Applicant and SUREBET or its underwriters, or the winner and SUREBET or its underwriters shall be governed by the laws of the State of Michigan, without regard
to its conflicts of laws, and submitted to binding arbitration in accordance with the rules of the American Arbitration Association. The venue for such arbitration shall be Kent County, Michigan.If for any reason there is litigation between the Participating Applicant, winner and/or SUREBET or its underwriters, the exclusive jurisdiction and venue for such litigation is a state district court in Kent County, Michigan. Both Participating Applicant & SUREBET agree to pay reasonable attorney’s fees and expenses associated with any such arbitration or litigation in the event either party successfully prosecutes and/or defend any such arbitration or litigation. Participating Applicant acknowledges that SUREBET and its underwriters are not party to or involved in the conduct or implementation of the eligible contest and therefore agree to protect, indemnify, and hold harmless SUREBET and its underwriters from any and all claims made due to the conduct or implementation of the eligiblec ontest which is in any way inconsistent with the Certificate of Coverage.

MISCELLANEOUS CONDITIONS

Any changes in the date, eligible contest hole number, eligible contest hole yardage, number of eligible shots, prize value, etc., require notification to SUREBET prior to the start of the contest. After normal business hours, changes are required in writing via fax (877) 556-6354 or emailed (sales@weinsurefun.com). Any fee adjustments will be billed or refunded after the eligible contest. Prize reimbursement will be prorated downward if a hole in one occurs and the actual number of eligible shots has been understated. Once you purchase a Certificate of Coverage for a contest, you may cancel your Certificate of Coverage and receive a full refund less a $60.00 cancellation charge if the contest is canceled for whatever reason prior to any eligible shot being taken in the contest. You must notify SUREBET via email (sales@weinsurefun.com) no later than the day of the canceled contest/event on Certificate of Coverage or a refund will not be possible. Please note that if you cancel a Certificate of Coverage prior to any eligible shot being taken in the contest,
any prizing (including premium prizing) is also canceled and you will receive a refund for any prizing fees charged during the original transaction. Also note that if you cancel a Certificate of Coverage and you have approved any customized items to go to print, no cancellation or refund will be available for those customized items. Alternatively, you may choose to have the Certificate of Coverage amended to a rescheduled date within ninety (90) days of the original contest without additional charge and without receiving a refund. For partially completed contests, before weather termination, SUREBET will provide you a partial credit to be used towards a rescheduled contest occurring within ninety (90) days of the original contest. The amount of the partial credit will be determined by calculating the percentage of unused shots in the original contest. All refunds will be provided via the same method the original payment was made. SUREBET reserves the right to use names, likenesses, photos, and videotape furnished by the Participating Applicant for marketing purposes without any compensation to any party involved in the eligible contest, unless otherwise noted on the certificate of coverage. Unless otherwise specified, SUREBET will reimburse the prize specified for up to three hole in one’s on each main prize hole. This Certificate of Coverage is a promotional event prize program contract, not insurance, and is not covered by any state guaranty association. SUREBET is the named Insured under a Policy issued by an A.M. Best A- Rated Carrier, which provides SUREBET with indemnification benefits for each and every enrolled event for Applicant. The Certificate of Coverage insures SUREBET’S obligations for the exclusive benefit of the Applicant. This disclosure is provided as a matter of information only and confers no rights upon a holder of a Certificate of Coverage.This provision does not amend, extend or alter the coverage afforded by the Master Policy.
